Minimum Wage Act in Germany with effect from 01-01-2015

 

To 01-01-2015 the general minimum wage was introduced in Germany.

 

The law is called officially: “Gesetz zur Regelung eines allgemeinen Mindestlohns (Mindestlohngesetz - MiLoG)“ (no official translation, provided by Ute Reusch, juris GmbH Saarbrücken: Act Regulating a General Minimum Wage (Minimum Wage Act)).

 

As opposed to present regulations it introduced a general minimum wage. Former regulations concerned only minimum wages specific for single branches.

 

By 01-01-2015 the minimum wage amounted 8.50 € per hour  (Sec. 1 sub. 2 s. 1 MiLoG: “Die Höhe des Mindestlohns beträgt ab dem 1. Januar 2015 brutto 8,50 Euro je Zeitstunde.“).

 

The “Mindestlohngesetz (MiLoG) “ concerns employee's protection right. Therefore the rights are inalienable („Sec. 3 MiLoG: “Vereinbarungen, die den Anspruch auf Mindestlohn unterschreiten oder seine Geltendmachung beschränken oder ausschließen, sind insoweit unwirksam. Die Arbeitnehmerin oder der Arbeitnehmer kann auf den entstandenen Anspruch nach § 1 Absatz 1 nur durch gerichtlichen Vergleich verzichten; im Übrigen ist ein Verzicht ausgeschlossen. Die Verwirkung des Anspruchs ist ausgeschlossen.“)

 

Beside the “Mindestlohngesetz (MiLoG)“  other regulations existed and exist furthermore in Germany. In principle (apart from exceptions) the “Mindestlohngesetz (MiLoG)“ forms the lower limit.

By 01-01-2017 the minimum wage amounted 8.84 € per hour (Sec. 1 "Verordnung zur Anpassung der Höhe des Mindestlohns (Mindestlohnanpassungsverordnung - MiLoV": "Der Mindestlohn beträgt brutto 8,84 Euro je Zeitstunde.").

By 01-01-2019 the minimum wage amounted 9.19 € per hour and by 01-01-2020 9.35 € (Sec. 1 "Zweite Verordnung zur Anpassung der Höhe des Mindestlohns (Mindestlohnanpassungsverordnung - MiLoV2".).

By 01-01-2021 the minimum wage amounted 9.50 € per hour, by 01-07-2021 9.60 €, by 01-01-2022 9.82 € and by 01-07-2022 10.45 € (Sec. 1 "Dritte Verordnung zur Anpassung der Höhe des Mindestlohns (Mindestlohnanpassungsverordnung - MiLoV3".).
